General Business Terms and Conditions

1. These General Business Terms and Conditions (hereinafter referred to as "GBTC") govern the method of using the Platius card of DreamCARD, s.r.o. (hereinafter referred to as "DreamCARD") in making purchases in the business network of contract partners of DreamCARD, s.r.o.. The DreamCARD (hereinafter referred to as "Card") can be used according to these GBTC in the network of all shops of contract partners of DreamCARD, s.r.o. throughout the Czech Republic. The Platius card shall be issued and managed by head office of DreamCARD, s.r.o., registered office at Terezínská 473/17, 360 07 Karlovy Vary. The Card shall always be issued to the holder by DreamCARD, s.r.o..

2. The applicant may include both a natural person and a legal person; however if a legal person applies, a currently valid Certificate of Incorporation must be provided. In case of a businessman, the Trade Certificate must be provided. The Card shall be provided by DreamCARD based on a signed application for issuing the Card by the customer. Such application shall be filed by the customer on a preprinted form or by completing the electronic form at Company's pages at www.dreamcard.cz. The head office of DreamCARD shall be entitled to reject the customer's application for issuing the DreamCARD, however, the rejection must not be for any discriminatory reason. The DreamCARD Company shall be entitled to reject the issuing of DreamCARD if such Card has been issued to the holder in the past and if the conditions for using the Card have been breached where the use is limited or prohibited by the DreamCARD Company.

3. The DreamCARD holder (hereinafter referred to as "Customer") shall mean a person, the name and surname of whom or a company of whom is stated in the application for issuing the Card. The Card validity period shall start by the day the Card is issued and end by the final day of the calendar month after the expiry of 12 months from the date the Card was issued.

4. The DreamCARD may be used for receiving discounts from privilege services and discounts in the network of shops of contract partners of DreamCARD.

5. The DreamCARD must be submitted at the cash desk before initiating any cashing transaction (before goods are scanned). The shop employees shall not be obliged to advise the customer of submitting the DreamCARD before scanning any goods. Using the DreamCARD together with other cards for the accumulation of bonuses, discounts or other provided advantages relating to the use of such cards shall be excluded.

6. In addition to receiving discounts in the network of business partners of DreamCARD, the DreamCARD holder shall also be entitled, after submitting the DreamCARD, to use these privilege services provided by the DreamCARD Company: free entry to events organised by DreamCARD.

7. The Card holder shall be obliged to immediately notify of any loss or theft of the DreamCARD at the customer service phone number. Based on an application filed on a preprinted form or using the electronic form, DreamCARD, s.r.o. shall issue for a fee of CZK 350 (three hundred and fifty) a duplicate of the Card that shall be sent to the Card holder by post to the last known address of the customer in 2 months after filing the application. The Card holder shall be obliged to make any change to the address, name and surname and other personal details stated in the application form for issuing the DreamCARD Card in the preprinted Application for Change of Contact Details or using the electronic form. Otherwise, the last known address of the customer shall be binding.

8. The DreamCARD shall be valid for 12 months. The Card validity period shall start by the day the Card is issued and end by the final day of the calendar month after the expiry of 12 months from the day it was issued. The customer Platius Card shall be transferrable. The DreamCARD shall remain the property of the issuer that shall at any time be authorised to require to be returned the Card.

9. The Card holder shall be authorised to terminate the contractual relation at any time by a written notice that shall be effective upon the delivery thereof to the head office of GNL Investments, s.r.o.. GNL Investments, s.r.o. shall be authorised to terminate the contractual relation at any time by a written notice with a one month notice period that shall start by the first day of the calendar month following the calendar month in which the notice was delivered to the last known address of the Card holder. Should it be unable to deliver the notice, the notice shall be deemed delivered by the day the registered letter is returned to the head office of DreamCARD, s.r.o.. The DreamCARD must be immediately returned upon the end of the contractual relation.

10. The DreamCARD Company shall reserve the right to improve the quality of or change the advantages provided through or related to the DreamCARD. Any change or amendment to these GBTC shall always be published by the DreamCARD Company and the written wording thereof shall be available at www.dreamcard.cz. Such changes shall take effect by the day of the publishing thereof.

11. The applicant hereby declares to have familiarised with the GBTC section - Protection of Personal Details and to expressly agree therewith with no reservation.

12. The applicant acknowledges with his/her signature the validity of these GBTC and considers them binding upon himself/herself.

13. The court subject and locally applicable under the provisions of the Civil Code shall be the competent court in matters regarding any disputes arisen in connection with the relation established by the DreamCARD system.

GBTC – Protection of Personal Details

With the registration through the Internet interface the DreamCARD applicant grants DreamCARD, s.r.o. his/her express consent to processing of his/her personal details including the details provided in the registration process and to processing of details of using services offered by the DreamCARD holder obtained by DreamCARD, s.r.o. during the membership in DreamCARD. Personal details may be processed for purposes of DreamCARD, s.r.o., i.e. for the needs of proper fulfilment of obligations arising from the membership in DreamCARD by DreamCARD, s.r.o. The DreamCARD applicant shall also provide DreamCARD, s.r.o. with consent to process the provided details and details obtained from the use of the DreamCARD (purchases and use of services in the business network of contract partners of DreamCARD, s.r.o.) and the use thereof within the business activities of DreamCARD, s.r.o., for purposes of marketing and promotional activities, in particular. The applicant especially agrees that DreamCARD, s.r.o. -itself or through a mediator - records personal details electronically, keeps, gathers personal details in both written and electronic form if necessary and to the extent necessary for providing the DreamCARD membership.

The consent to personal details processing shall be valid throughout the membership in Platius club-e. DreamCARD, s.r.o. shall be responsible for the safety of personal details and complying with obligations under the Act on Protection of Personal Details: No. 101/2001 Coll. on protection of personal details and change to some acts.

  • Electronic mail address – for sending order confirmation, an emergency mean of communication if the customer is not available at the given phone number.

Necessity of Providing Personal Details

The operator shall obtain only those personal details that shall be necessary for the fulfilment of obligations arising from the membership in DreamCARD. Without these details, it shall not be possible to process any received application for the membership in DreamCARD. For this reason, the applicant shall be obliged to complete all the required details in registering for DreamCARD.

Third Parties to Which Details Shall be Provided

DreamCARD, s.r.o. shall not provide the personal details to any companies managing personal details databases or any third parties, except to the extent necessary for the delivery of goods:

  • Courier company
  • Česká pošta, a.s.

Extent of details provided: Name and surname and address of the recipient, delivery address, recipient (for a courier company). In exceptional cases, a different courier company may be selected for the delivery of goods by an operational decision. Considering the flexible nature of the decision, the name and head office of such company is not possible to know in advance.

Details Publishing

In any case, DreamCARD, s.r.o. shall not publish the obtained details.

Rights and Obligations of a Person Concerned

The applicant is obliged to give complete and true details only.

Should there be any change to the personal details of the applicant, he/she undertakes to notify DreamCARD s.r.o. thereof.

The applicant undertakes that in case he/she provides any personal details of a third party as delivery details (name, surname, address) he/she shall do so only with the consent of such party and the person concerned shall be familiarised with the procedures, rights and obligations given on this page.

Based on a written application (letter, electronic mail), the person concerned shall have the right to require from the operator the following:

  • Information on the state of processing of his/her personal details.
  • Information on the source from which the operator has obtained his/her personal details.
  • Removal of his/her personal details subject to processing.
  • Correction of his/her inaccurate, incomplete or no more applicable personal details subject to processing.
  • Liquidation of his/her personal details.
  • Adjustment of personal details

All justified requirements of the person concerned shall be met and the person concerned shall be notified thereof in 30 days after receiving the requirement.
